Dispute settlement

In case of death, injury, loss or damage to natural or legal persons from the State(s) in which the operation is conducted, the Republic of Korea shall, when its liability has been established, pay compensation under the conditions provided for in the applicable status of forces agreement referred to in Article 3(1).

The Union shall exempt the Swiss Confederation from any financial contribution to the common costs of EUBAM Libya.

Article 333

Any Party may at any time submit to the Secretariat a list of species which it identifies as being subject to regulation within its jurisdiction for the purpose mentioned in paragraph 3 of Article II.

However, products constituting one single consignment may be transported through other territories with, should the occasion arise, trans shipment or temporary warehousing in such territories, provided that they remain under the surveillance of the customs authorities in the country of transit or warehousing and do not undergo operations other than unloading, reloading or any operation designed to preserve them in good condition.

Where disputes arise in relation to the verification procedures of Article 30 which cannot be settled between the customs authorities requesting a verification and the customs authorities responsible for carrying out this verification, they shall be submitted to the Joint Committee.

This Chapter shall not apply to research and development projects or to demonstration projects carried out on a non commercial scale.

CHAPTER 11

The Parties shall enter into consultations if one of them considers that the other has failed to fulfil an obligation under this Agreement.

From the date of the entry into force of this Agreement, the Executive Director shall present every four years to the Board of Governors, a report on the activities of the Foundation.

A Party may, only in exceptional circumstances or pursuant to a judicial order, permit the defendant to obtain possession of suspect goods by posting a bond or other security.

Decisions taken by the Joint Committee shall be agreed by both parties.

The Joint Committee may decide to set up subcommittees or working groups that could assist it in its work.

The Parties shall conduct reciprocal security consultations and assessment visits to evaluate the effectiveness of the security measures applied by each Party to the classified information provided by the other Party under this Agreement and under the implementing administrative arrangements referred to in paragraph 1.

Termination

The amendment shall enter into force following the expiry of a period of one year after the date on which it has been forwarded to the Parties.

The date and place of each meeting, as well as the agenda, shall be determined by agreement between the Parties.

It shall also meet at the request of either Party.

The scope and duration of the measures referred to in paragraph 1 shall be confined to what is necessary to control a situation and ensure that there is a fair balance between the rights and obligations under this Agreement.
